Scope of Authority

Sign and file protests, petitions, and refund claims
Arrange delivery of goods after customs release

Option A: Valid until revoked in writing
Option B: Valid for shipments from date to date
Option C: Valid for shipment B/L or invoice number only

Indemnification

Principal agrees to indemnify Agent against all claims arising from inaccurate information provided by Principal.

When You Need a Customs POA

First-time import — Required before your broker can file the first entry
New broker relationship — Each broker needs their own POA
Change of company structure — Mergers, acquisitions, or legal entity changes void existing POAs
DDP shipments — If your supplier handles destination customs under DDP terms, they need a POA from the destination entity

US Customs POA Requirements (CBP)

Per 19 CFR 141.46, a valid US customs POA must:

Be in writing and signed by the importer (or authorized officer)
Identify the broker by name
Specify the scope of authority granted
Be valid under the laws of the state where the importer resides
Remain in effect until revoked by either party
For non-US importers: must include a US agent/resident authorized to accept service of process
